Note: A Polish version of these Terms will be made available. In case of discrepancies between language versions, the Polish version shall prevail for Polish consumers.

1. General Provisions

1.1. These Terms and Conditions ("Terms") set out the rules for using the online store available at Refura.pl (the "Store"), including placing orders and purchasing refurbished products.

1.3. You can contact us using the details above for any questions about the Store, orders, complaints or these Terms.

1.4. The Store sells mainly refurbished and used electronic devices and accessories to consumers in Poland and other EU/EEA countries.

1.5. The Store is intended for persons who are at least 18 years old. Minors may use the Store only with the consent and supervision of a parent or legal guardian.

1.6. These Terms are made available free of charge on the Website in a way that allows you to store and reproduce them (e.g. download as PDF or print).

2. Definitions

In these Terms:

Customer

Any natural person, legal person or organisational unit that uses the Store.

Consumer

A natural person entering into a contract with us for a purpose that is not directly related to their trade, business or profession, as defined in Polish law.

Entrepreneur-Consumer

A natural person entrepreneur (sole trader) entering into a contract directly related to their business activity, where it follows from the content of the contract that it does not have a professional character for them, in particular with regard to the PKD codes entered in the Central Register and Information on Economic Activity (CEIDG).

Business Customer

Any Customer who is an entrepreneur but is not a Consumer or Entrepreneur-Consumer, including in particular companies and entrepreneurs for whom the contract has a professional character.

Account

A free Store account created by the Customer.

Business Day

A day other than Saturday, Sunday or public holiday in Poland.

Goods

Products offered in the Store, in particular refurbished or used electronic devices and accessories.

3. Using the Store and Account

3.1. You can browse products without creating an Account. To place an order you may:

  • Register an Account, or
  • Use the guest checkout

3.2. When registering an Account, you must provide truthful and up-to-date information. You are responsible for keeping your login details confidential.

3.3. You must not use the Store in a way that:

  • Violates the law or these Terms
  • Disrupts the Store's operation, or
  • Infringes the rights of others

3.4. We may temporarily suspend or terminate your Account if you seriously or repeatedly breach these Terms, after informing you and if appropriate giving you an opportunity to explain.

4. Orders and Conclusion of Contract

4.1. Product descriptions on the Website are an invitation to make an offer, not a binding offer.

4.2. To place an order, you must:

  • Select products and add them to the cart
  • Go to checkout
  • Provide required data (delivery address, billing details, contact details)
  • Choose delivery method and payment method
  • Read and accept these Terms and the Privacy Policy
  • Submit your order by clicking the button "Order with obligation to pay" or similar

4.3. By submitting an order, you make us an offer to purchase the selected Goods.

4.4. After you place your order, we will send an email order confirmation. The contract of sale is concluded when you receive our confirmation email.

4.5. If we cannot fulfil your order (for example because the product is unavailable or the payment is not authorised), we will inform you and refund any payment received without undue delay.

5. Prices and Payments

5.1. All prices in the Store:

  • Are given in PLN (Polish złoty)
  • Include applicable VAT, and
  • Do not include delivery costs (shown separately during checkout)

5.2. Before you submit your order, you will see the total price, including taxes and delivery charges.

5.3. We accept the following payment methods:

  • Online payments via payment intermediaries (e.g. Przelewy24, PayU, Stripe, PayPal, card payments)
  • Bank transfer
  • Buy-now-pay-later or instalment providers (if offered)

5.4. Detailed information about payment methods and providers is available on the Website and during checkout.

5.5. If payment is not received within the time specified by the chosen method, we may cancel or suspend your order.

5.6 Payment Disputes and Chargebacks

If you dispute a transaction or request a chargeback with your payment provider (bank, card issuer, or payment processor), we will investigate. If we determine the transaction was authorised by you and the goods were delivered as described, we reserve the right to:

  • Provide evidence to your payment provider and/or law enforcement
  • Pursue recovery of unauthorised chargebacks through legal channels
  • Suspend your Account and prevent future purchases until resolved

If you have a legitimate dispute about an order, please contact us first at [email protected] before initiating a chargeback. Nothing in this section limits your statutory rights to dispute unauthorised or incorrect transactions with your payment provider.

6. Delivery

6.1. We deliver Goods to addresses in Poland and other selected EU/EEA countries (as indicated on the Website).

6.2. Available delivery methods (courier, parcel lockers, postal services), delivery times and costs are shown on the Website and at checkout.

6.3. The delivery time is calculated from the moment:

  • We receive payment (if prepayment), or
  • We send the order confirmation (if cash on delivery is available)

to the moment the Goods are handed over to you.

6.4. The risk of loss or damage to Goods passes to you when you (or a person you indicate) take possession of them. If you choose your own carrier (not offered by us), the risk passes when we hand the Goods to that carrier.

7. Refurbished Products: Condition and Grading

7.1. Most Goods sold in the Store are refurbished or used products. Their condition may differ from new goods, but they must still be in conformity with the contract (fit for normal use, as described, and with no hidden defects).

7.2. For each product we clearly indicate:

  • Whether it is refurbished / used
  • The cosmetic grade (e.g. A, B, C or similar)
  • Any visible signs of use (scratches, dents, etc.), and
  • Any missing accessories or special limitations

7.2A Product Condition Grades

We use the following condition grades for refurbished products. Each product page clearly shows which grade applies:

Grade A (Like New / Excellent)

  • Minimal or no visible signs of use
  • Original or equivalent accessories and packaging included, unless stated otherwise on the product page
  • Fully functional with no defects
  • May have very minor cosmetic marks only visible upon close inspection

Grade B (Very Good)

  • Light signs of use (minor scratches, small dents)
  • Fully functional
  • May include original accessories; packaging may be basic
  • No significant defects

Grade C (Good)

  • Visible signs of use (scratches, scuffs, marks)
  • Fully functional with no material defects
  • May be missing some original accessories
  • Battery/components may show age but function normally

Grade D (Heavily Used / For Parts)

  • Significant cosmetic wear
  • May have cosmetic or minor functional issues, but the main functions described on the product page work as stated
  • Original accessories may be missing
  • Not recommended as primary device
  • If a device is sold only for parts and is not fully functional, this will be clearly indicated on the product page, and your statutory rights will still apply

For each product, we provide photos showing the actual condition and list any known issues or missing parts.

7.3. Normal wear and tear consistent with the described grade and use is not considered a lack of conformity.

7.4 Data Erasure for Refurbished Electronics

For refurbished electronic devices (smartphones, tablets, laptops, etc.), we certify that:

  • We erase all previous owner data using professional data-wiping tools as part of our refurbishment process
  • SIM cards, memory cards, and other removable storage media are removed
  • We process personal data in line with the GDPR and ensure that all previous owner data is securely erased before devices are resold

However, you remain responsible for:

  • Backing up your own data before returning a device to us
  • Performing a factory reset on devices you return to us (recommended)

For your peace of mind, we recommend backing up your data and performing a factory reset and/or enabling full-disk encryption before sending a device to us, unless our trade-in instructions say otherwise.

7A. General Product Safety (GPSR)

All refurbished products we sell must comply with the EU General Product Safety Regulation (GPSR) 2023/988, which has applied since 13 December 2024.

This means:

  • All refurbished goods must be safe for consumers under foreseeable use
  • We verify that products are properly labelled with manufacturer details and batch/serial numbers as required
  • Products previously on the EU market that complied with safety laws when originally sold may remain on the market
  • If a product was never placed on the EU market before, it must meet current GPSR requirements or we will not offer it for sale

If you believe a product is unsafe or non-compliant with GPSR requirements, please contact us immediately at [email protected].

Non-compliance with GPSR standards is a serious safety matter and we take it as seriously as any statutory defect.

If we become aware that a product we supplied is unsafe, we will take appropriate action, which may include informing you, withdrawing or recalling the product, and cooperating with market surveillance authorities as required by law.

8. Right of Withdrawal (Returns)

This Section applies only to Consumers and Entrepreneur-Consumers.

Business Customers do not have a statutory right of withdrawal from distance or off-premises contracts. Any withdrawal or return by a Business Customer is possible only on the basis of an individual agreement with us.

8.1. If you are a Consumer or Entrepreneur-Consumer, you have the right to withdraw from a distance contract within 14 days without giving any reason, in accordance with the Polish Consumer Rights Act implementing the EU Consumer Rights Directive.

8.2. The withdrawal period ends 14 days after:

  • The day you receive the Goods, or
  • If the order consists of multiple items delivered separately, the day you receive the last item

8.3. To exercise your right of withdrawal, you must inform us of your decision by an unequivocal statement (for example, by email or letter). You can use the model withdrawal form available on the Website, but it is not mandatory.

You may also be able to withdraw directly via your online account or order history, if this function is available in the Store.

8.4. To meet the withdrawal deadline, it is sufficient that you send your notice before the 14-day period has expired.

8.5. If you withdraw:

  • We will refund all payments received from you, including the initial delivery costs (up to the cost of the cheapest offered delivery)
  • Without undue delay and no later than 14 days after we are informed of your decision

8.6. We may withhold the refund until we receive the Goods back or you provide proof of having sent them back, whichever is earlier.

8.7. You must send back the Goods to the address specified on the Website without undue delay and in any event no later than 14 days from the day you communicated your withdrawal.

Return Shipping Costs

For returns within 14 days due to your change of mind: you pay return shipping costs unless we clearly state otherwise on the product page or during checkout.

For returns due to lack of conformity/defects: we provide and pay for return shipping.

8.8. You are responsible for any diminished value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning (similar to what is normally allowed in a physical store).

What is Normal Handling (no deduction):

  • Opening the original packaging to inspect the product
  • Checking if it powers on and basic functions work
  • Testing for the same duration as you would in a physical shop
  • Transporting it safely

What is Excessive Handling (deduction may apply):

  • Using the product extensively (e.g. intensive gaming for 5 hours, using a phone as your primary device for a week)
  • Exposing it to water, dirt, or physical damage
  • Removing non-removable stickers or labels
  • Attempting to repair or modify the product
  • Missing original accessories when returned (e.g. charger, cables) may result in a reasonable deduction from the refund

Original packaging is not required, but you should pack the product safely so it is not damaged in transit.

For refurbished goods, normal wear and tear consistent with the stated grade is acceptable and will not result in deduction.

If you believe a deduction is unfair, you can file a complaint (see Section 10).

8.9. The right of withdrawal may not apply in certain cases expressly provided by law (for example, custom-made goods, goods that deteriorate quickly, sealed items that cannot be returned for health or hygiene reasons once unsealed). If any such exceptions apply, we will clearly indicate them in the product description.

9. Lack of Conformity and Complaints

The rules in this Section concerning lack of conformity of goods with the contract apply to Customers who are Consumers or Entrepreneur-Consumers, in accordance with the Polish Consumer Rights Act.

In relations with Business Customers, the provisions of the Civil Code apply, and we may limit or exclude statutory liability to the extent permitted by law. In contracts concluded exclusively with Business Customers, our statutory liability for defects (rękojmia) is excluded to the maximum extent permitted by the Civil Code. Any liability for defects will arise only from an expressly agreed commercial warranty (if granted).

9.1. We are liable to Consumers and Entrepreneur-Consumers for any lack of conformity of Goods with the contract that exists at the time of delivery and becomes apparent within the applicable statutory liability period, in line with EU and Polish law implementing the Sale of Goods Directive.

9.1A Warranty Period

All products sold by Refura are refurbished goods. The statutory warranty period is 1 year from delivery, as permitted by Polish law for used goods.

During this period, you have the right to repair, replacement, price reduction, or refund if defects are discovered.

9.2. If the Goods are not in conformity with the contract, you may demand:

  • Repair or replacement (primary remedies), or
  • If repair or replacement is impossible or disproportionate, or not carried out in a reasonable time, you may request price reduction or termination of the contract (refund)

9.3. To make a complaint about Goods, please:

  • Contact us by email or in writing
  • Provide your contact details, order number, description of the defect and your preferred remedy (repair, replacement, price reduction or refund)
  • Attach photos if helpful

9.4. We will respond to your complaint without undue delay, usually within 14 days. If we do not respond within 14 days, the complaint may be deemed accepted under applicable law.

9.5. This statutory liability is separate from any commercial guarantee (warranty) provided by us or a manufacturer. If such a guarantee is offered for a product, its terms will be described on the product page. A commercial guarantee does not limit your legal rights.

10. Complaints About Store Operation

10.1. You may also submit complaints about the functioning of the Store (e.g. Account issues, technical errors).

10.2. Please describe the problem and send your complaint to [email protected] or to our postal address. We will respond without undue delay, usually within 14 days.

10A. Abuse Prevention

10A.1. We reserve the right to refuse future orders from Customers who abuse return or complaint procedures, while always respecting their statutory rights in relation to past purchases.

Examples of abuse may include (but are not limited to):

  • Repeatedly ordering products with the clear intention of returning them after use
  • Filing fraudulent or manifestly unfounded complaints
  • Returning products that have been damaged through misuse and claiming they were defective
  • Requesting chargebacks after receiving goods and failing to respond to our attempts to resolve disputes

10A.2. Before exercising this right, we will:

  • Inform you of our concerns
  • Give you an opportunity to provide an explanation
  • Consider your response in good faith

10A.3. This clause does not affect your statutory rights regarding any purchase you have already made, including warranty claims, complaints about lack of conformity, or the right of withdrawal where applicable.

11. Newsletter and Marketing

11.1. You may voluntarily sign up for our newsletter or other marketing communications (email, SMS, phone) by giving your separate consent.

11.2. You can withdraw marketing consent at any time, for example:

  • By clicking the unsubscribe link in emails
  • By replying STOP to SMS (if applicable)
  • Via your Account settings, or
  • By contacting us

11.3. Withdrawal of consent does not affect the lawfulness of processing before withdrawal and does not affect the possibility to shop in the Store.

11.4. Details of how we process personal data for marketing purposes are set out in our Privacy Policy and must comply with the Polish Electronic Communications Law and GDPR.

12. Technical Requirements

12.1. To use the Store, you need:

  • A device with Internet access
  • A current web browser (e.g. Chrome, Firefox, Safari, Edge)
  • An active email address
  • Cookies and JavaScript enabled (at least for strictly necessary functions)

12.2. We make reasonable efforts to ensure the Store works correctly with common combinations of devices, operating systems and browsers.

13. Out-of-Court Dispute Resolution

13.1. We make every effort to resolve issues amicably. If a dispute arises, you may use out-of-court complaint and redress procedures.

13.2 Alternative Dispute Resolution (ADR)

If you are not satisfied with how we handle your complaint, you may use alternative dispute resolution services:

  • Polish Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl
  • Provincial Inspectorate for Trade Inspection (WIIH)
  • Local consumer ombudsmen or consumer organisations
  • Your national consumer authority or ombudsman (if outside Poland)

Note: The EU Online Dispute Resolution (ODR) platform was discontinued in March 2025. Please use the national ADR services listed above.

These procedures are typically free and do not prevent you from taking legal action. Information about out-of-court procedures is available from UOKiK and equivalent institutions in your country of residence.

14. Governing Law and Jurisdiction

14.1. These Terms and any contracts concluded via the Store are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and other applicable regulations.

14.2. If you are a Consumer residing in another EU/EEA country, this choice of Polish law does not deprive you of the protection granted by mandatory provisions of the law of your country of residence.

14.3. Any disputes between us and Customers who are not Consumers will be submitted to the competent Polish court for our registered office.

15. Application of Consumer Rights

Nothing in these Terms extends any statutory consumer rights to Business Customers beyond what is expressly required by applicable Polish and EU law.

Where Polish law grants certain Consumer rights also to Entrepreneur-Consumers, those rights apply regardless of these Terms.

16. Changes to the Terms

16.1. We may amend these Terms, in particular due to:

  • Changes in the law
  • Changes in the functionality of the Store
  • Changes in payment or delivery methods

16.2. For existing Accounts:

  • We will inform you about material changes in advance (for example by email or via the Store interface)
  • The new Terms will apply to new contracts (new orders) after the effective date

16.3. The current version of the Terms is always available on the Website.
